Advertising Restrictions

The practice of law is not a commercial activity; under Article 135 of the Constitution of the Republic of Türkiye, it is carried out as a public service through professional bodies having the status of Public Institutions.
Under Article 55 of Attorneys' Act No. 1136: "Attorneys are prohibited from taking any action or initiative that could be considered advertising in order to obtain work, and in particular from using, on their signboards and printed materials, any title other than that of attorney and their academic titles. (Added: 2/5/2001-4667/art. 35.) This prohibition also applies to joint attorney offices and attorney partnerships. (Added: 2/5/2001-4667/art. 35.) The principles relating to the above prohibitions shall be determined by regulation issued by the Union of Turkish Bar Associations."
Article 7 of the Union of Turkish Bar Associations' Professional Conduct Rules for Attorneys provides: An attorney must scrupulously avoid any unnecessary conduct directed solely at gaining reputation.
a. An attorney may only announce a change of address, in a manner that does not carry the character of advertising, by way of notice.
b. An attorney's letterheads, business cards and office signage may not be excessive to the point of carrying the character of advertising.
c. An attorney may have their address listed in the professions section of a telephone directory. Beyond this, they may not use lettering of a different size or wording of the nature of an announcement.
d. Attorneys who establish a joint office must take care that the office does not become a vehicle for advertising and does not lose its character as a law office.
Article 8 provides: An attorney shall refrain from any conduct that has the character of procuring work for themselves.
